  • “We,” “Us,” and “Our” refer to Buff-N-Shine Car Wash, its employees, affiliates, and any entities acting on behalf of Buff-N-Shine.
     

  • “Services” refer to all car wash packages, membership plans, and additional services provided at our premises.

  • “Online Store” refers to the e-commerce platform accessible via the Buff-N-Shine Car Wash website where users can purchase wash passes, club memberships, and other products or services.

  • “ICS” refers to Innovative Control Systems, Inc., the third-party provider that powers the payment gateway, membership system, ALPR (Automatic License Plate Recognition) technology, and manages our online store infrastructure through its design agency, The Agency at ICS.

2. Agreement to Terms


By accessing our website or using Buff-N-Shine Car Wash services, you agree to comply with these Terms & Conditions. Your continued use of the services after any updates or modifications to these terms constitutes acceptance of the updated Terms & Conditions. The latest version of these terms will always be posted on our website and becomes effective immediately upon posting.

3. Service Usage


The use of Buff-N-Shine’s services, including car wash packages and memberships, is subject to the specific rules outlined in our Terms of Service. The services provided are dependent on availability and may be impacted by operational hours, weather conditions, or other unforeseen circumstances.

4. Purchases and Third-Party Payment Terms


4.1 In-Person Purchases


All services, including car wash packages and memberships, can be purchased in person at our kiosks located on Buff-N-Shine premises. These kiosks are operated by a third-party point-of-sale provider, which handles payment processing.

 

4.2 Online Purchases

 

In addition to in-person purchases at Buff-N-Shine kiosks, services, memberships, and wash passes are also available to be purchased through our online store. Online transactions are processed through the ICS-powered payment gateway and are subject to the same payment terms described herein.Our online store, located at https://buffnshinecarwash.store, is managed and maintained in collaboration with The Agency at ICS. While Buff-N-Shine governs product offerings and customer support, ICS facilitates technical operations and payment infrastructure.

4.3 Third-Party Payments


All payments made for Buff-N-Shine services are processed securely through a third-party payment gateway. Buff-N-Shine will make reasonable efforts to assist in resolving any payment disputes or issues (such as card declines, processing errors, or billing discrepancies) that arise in connection with the third-party payment system. All transactions, whether conducted in person or online, are handled via the ICS system and subject to ICS’s applicable payment processing policies.

However, please note the following:

  • You, the customer, are responsible for ensuring that accurate and up-to-date payment information is provided at the time of the transaction.

  • Any fees, charges, or penalties arising from failed or disputed payments (e.g., insufficient funds, expired cards) remain your responsibility.

​​

  • Payment disputes cannot be initiated directly with the third-party payment provider by the customer. All disputes or inquiries related to payments must be addressed with Buff-N-Shine, which will then liaise with the third-party provider to attempt to resolve the issue on your behalf.


By using Buff-N-Shine services and submitting payments through our third-party provider, you acknowledge and agree to these terms.

5. Privacy Policy and Data Protection


Buff-N-Shine is committed to protecting your privacy and managing your personal data in accordance with applicable privacy laws, including the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR).

5.1 Data Collection


We collect personal information, including license plate data for membership identification, contact information, and payment details. This information is collected solely for operational purposes, such as managing memberships, payment processing, and verifying service use. Additional information such as IP address, browser/device metadata, and order history may also be collected when purchases are made online.

Membership Management: License plate recognition for membership verification.

Payment Processing: Billing and processing of service payments.

​

8.1 Vehicle Condition


You are responsible for ensuring that your vehicle is in a suitable condition for washing. This includes closing windows, securing sunroofs, and removing personal belongings. Buff-N-Shine is not liable for damages caused by pre-existing vehicle conditions or user negligence.

8.2 Personal Items


Buff-N-Shine is not responsible for lost or damaged personal items left inside the vehicle during the wash process.

9. Disparagement Clause


By using Buff-N-Shine’s services, you agree not to make any false, misleading, or defamatory statements regarding Buff-N-Shine, its employees, or its services. Any violation of this clause may result in the termination of your services and potential legal action for damages.

10. Limitation of Liability


Buff-N-Shine is not responsible for any damages that may occur during the normal course of service operations, unless such damages are caused by proven negligence on our part. This includes, but is not limited to:

  • Mechanical damage not related to our service.

​

  • Damages resulting from user negligence (e.g., unsecured windows, personal items).


Additionally, Buff-N-Shine is not liable for any indirect, incidental, consequential damages, or any other related losses.

11. Indemnification

Changes to services may include pricing, membership plans, or the discontinuation of certain service offerings.

These Terms & Conditions are governed by and construed in accordance with the laws of the State of California. Any legal disputes arising from the use of Buff-N-Shine services will be resolved exclusively in the courts located in Orange County, California.
